A Means to Amend: Mediation in Planning

James McKenzie will discuss the benefits of negotiation and mediation as means of reducing planning appeals and avoiding contested hearings before the OMB. Drawing on his experience and cases, he will share the top-five ingredients for success in negotiation and mediation. Participants will be asked to share experiences dealing with conflict in planning process and identify some of the challenges they’ve confronted. The resulting discussion will focus on best practices and suggestions about approaches and tools for achieving consensus in those situations. 
 
Learning Objectives:
  • Gaining knowledge about when and how mediation can be used throughout the planning process.
  • Gaining knowledge about how recent changes to the Planning Act regarding new mediation approaches can be used to reduce the necessity for OMB hearings.
