Nexus of Planning and Human Rights

October 06, 2015

3:15pm-4:15pm

The Provincial Policy Statement 2014 requires that it be implemented in a manner that is consistent with the Ontario Human Rights Code and the Canadian Charter of Rights and Freedom. This session explores what this means for planning professionals.

In the last three to four years, the Ontario Municipal Board has been hearing arguments about planning decisions allegedly discriminating against persons protected by the code (e.g., persons with disabilities). In one decision, the OMB sent a municipality back to the table to consider the human rights implications of its planning decision—it required more than a perfunctory consideration of the human rights effects of planning decisions.
