This session will explore what is meant by “facilities, services or matters” in the application of section 37 and compare how municipalities define community benefits. Participants will learn about the section 37 process, how section 37 considerations are triggered and the elements that go into an agreement. Also, the session will explore the legislative framework that allows municipalities to use bonus zoning provisions. In the City of Toronto rezoning for higher density is a feature of most new development and the city has used section 37 provisions more than any other municipality in Ontario. This session will identify what other municipalities should learn from its example.
